Terms & Conditions

Terms & Conditions of Order & Payment

  

  1. These terms and conditions form the basis of the contract between Cake it Easy and you, the Client.
  2.  Along with your Order Confirmation Form, these Terms & Conditions are considered by Cake it Easy to set out the agreement between you, the Client and Cake it Easy, in its entirety, for the sale of cakes and any other relevant goods and accessories. 
  3. It is your responsibility to check all details in the order confirmation are complete and accurate and to bring any discrepancies to the notice of Cake it Easy within 72 hours of receipt of your Order Confirmation Form. 


Order Schedules 


Orders usually require a minimum of One Calendar Month’s notice. 


However, if you have a design which is very large or intricate, or which may require the order of special ingredients or construction of specialist embellishments, we would appreciate as much notice as possible to ensure we can accommodate your requirements fully. 


Cakes can be produced at short notice on occasions depending upon your requirements and our schedule, however any orders placed at less than 14 days notice will require full payment at the time of booking. 


Booking Fees & Payments


  • For general orders, a non-refundable booking fee of 50% is required to confirm your booking.
  • In the case of Wedding Cakes, a non-refundable minimum booking fee of £100 is required to confirm booking.
  • Bookings cannot be confirmed until the booking fee has been paid. 
  •  If a full booking fee is not received within the time specified, Cake it Easy reserves the right to accept alternative bookings for the date you require. We have limited availability, so if a booking fee is not forthcoming and we receive another booking request, you risk losing your required delivery/collection date. 
  • Full payment of the outstanding balance for general orders is required 7 days before delivery/collection. 
  •  In the case of Wedding Cakes, full payment is required 1 month prior to the date of delivery.
  •  Cake it Easy will provide a written Order Confirmation Form to you following receipt of your booking fee, which will confirm your booking, details of the order and relevant dates for payments and delivery/collection. 
  •  Failure to complete full payment by the date given on your Order Confirmation Form could result in the cancellation of your order and loss of booking fee. 
  • It is the client’s responsibility to check the details on the Order Confirmation Form and notify Cake it Easy of any anomalies/corrections within 3 days of receipt.
  • The Order  Confirmation Form is considered to be a Contractual Document between Cake it Easy and the Client.


  

Alterations


Should you wish to make any alteration to the design of your order, you may do so up to one calendar month prior to the date of delivery/collection. However, Cake it Easy reserve the right to refuse any alterations to the original design should there be insufficient time left to create extra details, figures, sculpting or modelling, or source specialist equipment, or should the alterations be deemed unachievable for any other reason. 

Should alterations be accepted, a new Order Confirmation Form will be issued detailing the changes and any new/additional cost. 

Alterations are not confirmed until a new Order Confirmation has been issued. 

No reductions in price will be provided in the respect of a request for alterations that result in a cheaper design than that initially agreed upon, unless Cake it Easy consider that the design is so radically different that it would result is considerably less time and/or skill or considerably less supplies and/or ingredients to create. 


Delivery/Collection 


  • Deliveries to locations local to Cake it Easy are made free of charge.


  • Delivery  to locations outside of the Leighton-Linslade area are charged in      accordance with distance to the venue and travelling time incurred


  • Minimum delivery charge of £10 will apply. 


  • You will be advised of any delivery charge at the time of booking and this cost will be detailed on your Order Confirmation Form. 


  • Collections are strictly by appointment only – should you attend without an appointment it is likely that you will be unable to collect your cake. 


In the case of Deliveries; 


  • Your cake will be delivered and set up at your venue. 


  • Once set up is complete, Cake it Easy will hold no further responsibility for the product. Cake it Easy will therefore not accept liability for any damage to the product that occurs beyond this point.  


  • Photographs may be taken at the point of completion of set up, as a record of the condition of your cake at the point at which Cake it Easy is no longer liable for damage. 


In the case of Collections; 


  • Cake it Easy will not accept any liability for damage to the product once it has left the premises. 


  • For this purpose, “Leaving the premises” means crossing the threshold of the front or rear entrance. 


  • Clients transport goods at their own risk. 


  • It should be borne in mind that cakes and their decorations are by nature fragile and can easily be damaged in transit if extra care is not taken. 


Food Allergies 


Please inform us of any food allergies at time of booking. You will find a field on the Order Form on the Contact Us page of the website for you to enter any special dietary requirements. Any such requirements will be detailed on the Order Confirmation Form and it is the responsibility of the Client to check and confirm these details within the specified timescales. If we are not informed of relevant allergies at the time of booking, we cannot guarantee that your cake will be free from relevant allergens, and we will hold no liability for this. 


  • A list of full ingredients for every cake is available upon request. 
  • A list of any known allergens present will be provided with every product. 
  • Care instructions for your cake will be provided at time of delivery/collection. 


Cake it Easy reserves the right to photograph all cakes produced and to use such photographs for promotion or any other purpose. 


All photographs and promotional material will remain the property of Cake It Easy. 


  

Unfulfilled Orders, Cancellations & Postponements

 

Cancellations by the Client;


In the event of a cancellation by you the Client, the following charges will apply without exception;


  • More than ninety days prior to the date of delivery/collection  -  booking fee only.
  •  Ninety days to one calendar month prior to the date of delivery/collection - booking fee plus half the total cost.
  • Less than one calendar month prior to the date of delivery/collection - full payment is required.
  • Any goods ordered at short notice (less than one calendar month prior to date of delivery/collection) require full payment at time of booking. 


Postponement by Client;


In the event of a postponement by you, the Client, the payments due remain the same as those outlined above for cancellations. 


Subject to the availability of Cake it Easy, any monies paid, may be transferred forward to the new date of the event, however this is entirely at the discretion of Cake it Easy. 


Only one transfer forward of monies paid will be accepted per order. Any subsequent postponements will be considered as a cancellation, and charges will be applied as outlined above. 


Orders that cannot be fulfilled by Cake it Easy;


In the unlikely event that an order cannot be fulfilled due to illness, accident, or emergency, on the part of Cake it Easy, a part or full refund of any monies already received may be applicable.


However, any refund (or partial refund) will be at the discretion of Cake it Easy and will only be applicable in instances whereby orders cannot be fulfilled, due to unforeseen and unavoidable circumstances on the part of Cake it Easy. 


In the event that any order cannot be fulfilled due to events which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Cake it Easy, Cake it Easy shall not be liable for any breach of contract resulting from such an event.


COVID 19


Due to the extraordinary circumstances created by the COVID 19 Coronavirus Pandemic, and the likelihood that Clients may find themselves in the unfortunate position of having to cancel/postpone their special events at the current time, some special exceptions may be granted regarding the timescales for the payments of booking fees and balance/settlement payments for future events. 


Payment of Booking Fees & Settlements


Any flexibility in the timescales for payment of booking fees, or settlement of full payments, will be at the discretion of Cake it Easy and will be offered on an individual basis to each Client dependant upon the nature of their order. 


Any such special exception offered will be fully detailed on the Order Confirmation Form and the dates agreed upon will be final and non-negotiable.


Booking fees will revert to the usual terms for any orders placed after 30/06/2020
